2. Initial Notice Follow-Up

Free template for following up on unresponsive DMCA takedown requests

Overview

This template is for following up on a DMCA takedown notice when a platform has not responded or taken action within a reasonable timeframe (typically 5-7 business days after your initial notice).

Free to Use

This template is provided free of charge for your use. However, Adult Model Protection is not liable for any outcomes resulting from the use of this template. For complex cases or legal advice, please consult with an attorney.

When to Use

Only use this template if you have already sent an initial DMCA notice and received no response or action after 5-7 business days. Do not send follow-ups prematurely, as platforms need reasonable time to process requests.

When to Use This Template

Use this follow-up notice when:

  • You sent an initial DMCA notice 5-7+ business days ago
  • You received no response or acknowledgment
  • The infringing content is still live
  • You verified you sent to the correct DMCA agent
  • You checked spam/junk folders for responses

Do NOT use if:

  • Less than 5 business days have passed
  • Platform has responded (even if content not yet removed)
  • You haven't sent an initial notice yet (use initial notice template first)
  • Content has been removed
  • Platform requested additional information (provide that instead)

Before You Send

Verify Your Initial Notice

Check that you:

  1. ✅ Sent to the correct DMCA agent email
  2. ✅ Included all required DMCA elements
  3. ✅ Provided specific URLs (not just homepage)
  4. ✅ Included your contact information
  5. ✅ Signed the notice properly

Check for Responses

Look in:

  • Primary inbox
  • Spam/junk folders
  • Promotions/updates folders
  • Any email filters you have set
  • Alternative email addresses you may have provided

Confirm Content Still Exists

Before following up:

  • Visit the infringing URLs
  • Verify content is still accessible
  • Take new screenshots with timestamps
  • Document that no action has been taken

Gather Information

You'll need:

  • Date you sent initial notice
  • Copy of your initial notice
  • Reference number (if provided)
  • Current status of infringing content
  • Any communication received (or lack thereof)

Dear Designated DMCA Agent for {Website/Platform Name}:

3. DMCA SAFE HARBOR REQUIREMENTS

Under the DMCA safe harbor provisions (17 U.S.C. § 512(c)), service providers must act "expeditiously" to remove or disable access to infringing material upon receiving proper notice.

The lack of response and continued hosting of infringing content may jeopardize your safe harbor protection under the DMCA. Failure to respond to valid DMCA notices can result in:

• Loss of DMCA safe harbor immunity
• Direct liability for copyright infringement
• Statutory damages up to $150,000 per work infringed
• Injunctive relief requiring content removal
• Potential legal action by copyright holders

I respectfully but urgently request that you:

1. Acknowledge receipt of this follow-up notice within 24 hours
2. Remove or disable access to the infringing content within 48 hours
3. Provide confirmation once the content has been removed
4. Explain any delays in processing my original notice

If I do not receive a response or see action taken within 5 business days of this follow-up notice, I will be forced to consider additional measures, including:

• Escalation to your hosting provider and domain registrar
• Filing a complaint with the U.S. Copyright Office
• Pursuing legal action for copyright infringement
• Reporting non-compliance to relevant authorities

━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━

5. REAFFIRMATION OF ORIGINAL STATEMENTS

I hereby reaffirm the statements made in my original DMCA notice:

• I have a good faith belief that the use of the copyrighted materials is not authorized by the copyright owner, its agent, or the law.
