4. Escalation Notice Follow-Up
Free template for sending a final DMCA demand to hosting providers or registrars before pursuing legal action
Overview
This template is for sending a final escalation notice to a hosting provider, domain registrar, or internet service provider (ISP) when your initial escalation notice has gone unanswered. This is the last formal step before legal action becomes necessary.
Free to Use
This template is provided free of charge for your use. Adult Model Protection is not liable for any outcomes resulting from the use of this template. For complex cases or legal advice, please consult with a qualified attorney.
Final Step Before Legal Action
This notice should only be sent after your escalation notice has received no response for at least 5 business days. Sending this notice signals that you are prepared to pursue legal remedies if action is not taken immediately.
When to Use This Template
Use this final escalation notice when:
- You sent an escalation notice to the hosting provider or registrar (5+ business days ago)
- No response or action has been taken
- The infringing content remains accessible
- You have documented all prior notices (initial → follow-up → escalation)
- You are prepared to pursue legal action if necessary
Do NOT use if:
- You haven't sent an escalation notice first
- Less than 5 business days have passed since your escalation notice
- The provider has responded (even if slowly) — give them time to act
- The content has already been removed
Understanding This Step
By this point, you have sent:
- Initial DMCA Notice — sent directly to the website owner
- Follow-Up Notice — sent after no response from the website owner
- Escalation Notice — sent to the hosting provider, registrar, or CDN
- This Final Notice — a last demand before legal action
This final notice carries significant legal weight. It puts the service provider on formal notice that you are aware of your legal rights and are prepared to act on them.
Before You Send
Complete this checklist:
- ☐ Escalation notice sent at least 5 business days ago
- ☐ No response or action received from the provider
- ☐ Content verified still live (take fresh screenshots with timestamps)
- ☐ Copies of all prior notices saved
- ☐ All notice dates documented
- ☐ Correct provider contact confirmed
