4. Escalation Notice Follow-Up

Free EUCD final escalation template — the last formal step before legal action against an EU platform

Overview

This template is for sending a final escalation notice to a hosting provider, domain registrar, or ISP when your initial escalation notice has gone unanswered. This is the last formal step before pursuing legal action under EU copyright law.

Free to Use

This template is provided free of charge for your use. Adult Model Protection is not liable for any outcomes resulting from the use of this template. For complex cases or legal advice, please consult with a qualified attorney.

Final Step Before Legal Action

This notice should only be sent after your escalation notice has received no response for at least 5 business days. Sending this notice signals that you are prepared to pursue legal remedies if action is not taken immediately.

When to Use This Template

Use this final escalation notice when:

  • You sent an escalation notice to the hosting provider or registrar (5+ business days ago)
  • No response or action has been taken
  • The infringing content remains accessible
  • You have documented all prior notices (initial → follow-up → escalation)
  • You are prepared to pursue legal action if necessary

Do NOT use if:

  • You haven't sent an escalation notice first
  • Less than 5 business days have passed since your escalation notice
  • The provider has responded (even if slowly) — give them time to act
  • The content has already been removed

Before You Send

  • ☐ Escalation notice sent at least 5 business days ago
  • ☐ No response or action received from the provider
  • ☐ Content verified still live (fresh screenshots with timestamps)
  • ☐ Copies of all prior notices saved
  • ☐ All notice dates documented
  • ☐ Correct provider contact confirmed
